End User License Agreement (EULA)

Corporate, trade and retail orders only. We are able to sell to corporate clients only, i.e. clients who run a business or are self-employed. On placing your order you confirm the intended use of our goods to lie within the framework of your business.

1 This is a contract.
Subject of the contract are the software (TrueType-, PostScript Type1- and OpenType-data) and the Typefaces ('fonts'), which shall be made available by Hubert Jocham, Osterriederstraße 2b, 87763 Lautrach, Germany. All Typefaces and all software on this website are the intellectual property of Hubert Jocham.

The contract between YOU and Hubert Jocham shall take effect as follows: Read the contract completely before you order a typeface. By receiving one or more Typefaces from this website you declare your willingness to observe the conditions of this contract. Should you conclude this contract on the behalf of your employers, then your employers, as you are, shall be subject to the conditions cited in this contract. In the event you should terminate your contractual relationship with your employers, you shall no longer be entitled to work with the Typefaces in accordance with the conditions of this contract whereas your employers shall still be entitled to these rights.

2 Grant of License
By paying the full sale price Hubert Jocham grants you a non-exclusive, non-transferable license (the "License") to operate its font software (the "Typefaces") on a fixed number of computers at a single location, as indicated on your invoice. You agree not to duplicate, reproduce, sell, transfer, license, or otherwise distribute the Typefaces in any form, except as provided herein. You agree not to decompile, modify, reformat, translate, reverse-engineer or otherwise discover the source code of the Typefaces. You agree not to make, or authorize or commission others to make, any additions, deletions or modifications to the Typefaces without the prior written consent of Hubert Jocham. You agree not to alter Hubert Jocham's copyright notices as contained in the Typefaces.

3 Copyright.
Hubert Jocham retains full title and ownership of these Typefaces both as artwork and software, including all subsequent copies of the artwork or software regardless of the format in which they are expressed or the media on which they are recorded. Any updates, revisions, enhancements or additions to the Typefaces supplied by Hubert Jocham under this Agreement shall become part of, and subject to, this Agreement. The parties agree that Hubert Jocham shall own the copyright in all such modifications and derivative works of the Typefaces made by either party. The names of these typefaces are trademarks of Hubert Jocham, and as such may only be used in keeping with accepted trademark practice, including identification of the trademark owner's name and only in conjunction with output produced using this font software. The parties agree that the Typefaces are the sole and exclusive property of Hubert Jocham, including all applicable rights to patents, copyrights, trademarks and trade secrets inherent therein and appurtenant thereto, and you agree not to challenge Hubert Jocham's rights thereto, or infringe the rights thereof. You acknowledge that you are not purchasing title to the Typefaces, but are rather being granted a license to use the Typefaces for the purposes set forth above. Except as provided herein, this Agreement does not grant you any intellectual property rights in the Typefaces.

4 Usage Restrictions
The typefaces and the software shall not be copied at more computer systems, as indicated in the invoice, which you get from Hubert Jocham. The typefaces and the software shall not be used together with or copied for any third parties. The typefaces and the software shall not be sublicensed or resold, rented or made available in any other manner to any third party. This applies in particular also to parts of typefaces, copies of parts or modifications of the typefaces. This license does not allow the use of a typeface in a manner where the typeface becomes the primary aspect of a product for resale. Modifying the typefaces is prohibited, even in the event that it is necessary for fulfilling personal design requirements.
Embedding of the typefaces and the software into electronic documents like PDF is permitted in a secured 'Preview & Print' mode. Licensee must ensure that recipients of electronic documents cannot extract the typefaces and the software from such documents or use the embedded typefaces and the software for the creation of new documents.
The typefaces may not be modified, adapted, translated, decompiled, disassembled, redigitized, rented, sold, given away, leased, sublicensed or loaned in any form. Additionally, you agree to take all steps necessary to prevent any third person from duplicating or distributing any typefaces and the software. Defamatory, offensive, pornographic or otherwise unlawful uses of the Typefaces and the software are prohibited.
Embedding of the Hubert Jochams font software into documents or internet pages is only permitted in a secured read/print-only mode and as long as the document itself is not a commercial product. If you need to embed Hubert Jochams font software that will not be in secured read/print-only environment and/or as the document itself is a commercial product, you must notify Hubert Jocham to purchase an additional license.

5 Warranty
Hubert Jocham warrants the typefaces and the software are free from defects in material and workmanship for 90 days as of the date of purchase. During this 90-day period, in the event of defect, Hubert Jocham will replace any defective products which are returned to Hubert Jocham. Your exclusive remedy for the breach of these warranties is the replacement of the product or the refund of the purchase price. Hubert Jocham makes no other warranty, express or implied, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. Hubert Jocham shall not be liable to you for any general, special, direct or indirect damage.

6 Liability.
In no event will Hubert Jocham be held liable for any consequential or incidental damages, including any lost profits or lost savings, or for any claim by any party, even if Hubert Jocham has been apprised of the possibility of such damages.

7 Breach and Termination
This license agreement will terminate automatically without notice from Hubert Jocham if you breach any of its provisions. With termination, you must immedia- tely stop using the typefaces and the software and delete all copies of the Typefaces and the software from all medias.

All rights to the typefaces, including their names and the software are owned by Hubert Jocham are protected by the copyright laws of Germany and other international provisions. If any part of this contract is found void and enforceable, it will not affect the validity of the balance of the contract, which shall remain valid andenforceable according to its terms. The parties consent and agree to the jurisdiction of the Landgericht München I in Munich, Germany.

This End User License Agreement for Web Use (“Web EULA”) covers any Webfonts created by Hubert Jocham (“Foundry”) and purchased through the hubertjocham.de website, (individually and collectively, the “Licensed Webfont(s)”). By using the Licensed Webfont(s) on any HTML website or web page (“Website”), the purchaser (the “Licensee”) agrees to the terms and conditions of this Web EULA.?The Licensee may use the Licensed Webfont(s) only on the web, for designing Websites, using the @font-face selector in CSS files, subject to the following restrictions:

1 The Licensee may not link to, nor put online, any version of the font not supplied in a Hubert Jocham Webfont Kit.

2 The comments, showing copyright and other legal information provided in the sample HTML/CSS/Javascript files, for each Licensed Webfont used, must be retained in Licensee’s working website code.

3 The Licensed Webfont(s) may be used on any Website owned or controlled by the Licensee (subject to paragraph 4 below). The total traffic, measured in page views, of Websites on which the Licensed Webfont is used must be no greater than the number of page views per month specified in the receipt you received for the Licensed Webfont(s).

4 Agencies responsible for multiple clients’ Websites, for example web design agencies or hosting providers, may not share a single Webfont license across multiple clients’ Websites.

5 The Licensed Webfont(s) may be used in a Website, where visitors produce “Styled Content” by directly or indirectly selecting a Licensed Webfont and entering or editing text using that Licensed Webfont, subject to the following conditions:
The Website may not enable or facilitate the Styled Content being used outside said Website, including but not limited to producing merchandise, PDF documents, image files, or personalized physical objects.?The Website’s font selection user interface must display the fonts’ original name(s) and cite Hubert Jocham as the source of the Licensed Webfont(s).

6 The Licensee may not use conversion or editing tools on the Licensed Webfont(s).

7 Use of the Licensed Webfont(s) with webfont technologies other than @font-face, such as sIFR, Cufón or Typeface.js, is not allowed.

8 The Licensed Webfonts are the property of their respective owners. Unauthorized copying or use of the Licensed Webfonts is expressly forbidden. You may be held legally responsible for any infringement of intellectual property rights that is caused or encouraged by your failure to abide by the terms of this Agreement.

9 Termination?This Agreement is effective until terminated. This Agreement will terminate automatically without notice if you fail to comply with any provision contained herein.

10 Disclaimer and Limited Warranty?Hubert Jocham warrants the Product to be free from defects in materials and workmanship under normal use for a period of twenty one (21) days from the date of delivery as shown on your receipt. Hubert Jocham' entire liability and your exclusive remedy as to a defective product shall be, at Hubert Jochams option, either return of purchase price or replacement of any such product that is returned to Hubert Jocham with a copy of the invoice. Hubert Jocham shall have no responsibility to replace the product or refund the purchase price if failure results from accident, abuse or misapplication, or if any product is lost or damaged due to theft, fire, or negligence. Any replacement product will be warranted for twenty one (21) days. This warranty gives you specific legal rights. You may have other rights, which vary from state to state.

EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE PRODUCT, IS PROVIDED “AS IS”. HUBERT JOCHAM MAKES NO WARRANTY OF ANY KIND, EITHER EXPRES- SED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

The entire risk as to the quality and performance of the Product rests upon you. Hubert Jocham does not warrant that the functions contained in the Product will meet your requirements or that the operation of the software will be uninterrup- ted or error free.

HUBERT JOCHAM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT EVEN IF HUBERT JOCHAM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
